Some guy rear-ended my mom and messed up the back end of it pretty badly. My mom's fine though, only a minor case of whiplash.
But it'll cost more to repair the damage than the car is worth ($8k-9k to repair, got the car for $7900).
And the insurance doesn't cover that much. So.
.....time for a new car. xD

We're going to stake a claim with his insurance, but I don't think we're going to sue.

If the other driver rear ended you they're automatically at fault, no matter the circumstances. If you have insurance or he at least has 3rd party insurance (which he pretty much has to by law) then you should be payed in full for the repairs.

I'm pretty sure in Arizona it falls under the same law, or a similar law. Also there's a law that if you have to be rescued because you drove into a flooded road and got stuck that you have to pay for the rescue. I love the name of it

To top it off, he had high-risk insurance even before he hit the BMW.
If his insurance doesn't pay us enough (the car was probably worth about 5-6k before it was hit), we're probably going to sue him.
