Contest Rules
GOLDEN SUN™: DARK DAWN FAN TRIVIA CONTEST ("PROMOTION") OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.
The Promotion is sponsored by Nintendo of America Inc. (“Sponsor”).
Promotion Period: The Promotion period is from 10:00 a.m. (all times Pacific Time) on Monday, November 29, 2010 to 10:00 a.m. on Monday, December 13, 2010 (the "Promotion Period"). All entries must be received by the end of the Promotion Period to be eligible to win a prize.
How to Enter: To enter the Promotion, you must visit Golden Sun Syndicate, a web site for fans of the Golden Sun™ franchise, located at http://www.goldensun-syndicate.net/ ("Fan Site") and e-mail your answers to the Golden Sun™: Dark Dawn trivia questions to the Fan Site during the Promotion Period.
Prize: Ten (10) winners will each receive a Golden Sun™: Dark Dawn Starter Kit, which includes: one (1) copy of the Golden Sun™: Dark Dawn video game and one (1) Midnight Blue Nintendo DSi XL™ video game system with a Nintendo DSi™ XL branded case. Approximate Retail Value ("ARV"): $350.00.
Odds of winning a prize depend on the number of submissions with all five correct answers received by Sponsor and how quickly such set of correct answers are received. Prizes will be shipped to U.S. addresses (within the 50 U.S. States and D.C. only) of the prize winners. Prizes returned as undeliverable or otherwise not claimed within 30 days after delivery of notification will be forfeited and may be awarded to an alternate winner. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Prizes won by a Minor (as defined below) will be awarded to a parent or legal guardian on the Minor's behalf. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.
Promotion Rules: The first 10 participants to correctly answer all five Golden Sun™: Dark Dawn trivia questions and e-mail their answers to [email protected] will receive a Golden Sun™: Dark Dawn Starter Kit. In the event that 10 participants do not correctly answer all five Golden Sun™: Dark Dawn trivia questions, the first 10 participants who answer the most questions correctly will receive a Golden Sun™: Dark Dawn Starter Kit. Golden Sun™: Dark Dawn trivia questions will be posted on the main page of the Fan Site at 10:00 a.m. on the first day of the Promotion Period. Potential winners will be notified by e-mail within two weeks of the end of the Promotion Period. To claim a prize, each potential winner must follow the instructions contained in his/her notification.
General Terms and Conditions: Limit one entry per person. Promotion is open only to residents of the 50 United States and District of Columbia who are over the age of 13. Directors, officers and employees of Sponsor and the Fan Site and any of its or their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. If you are under the age of 18 (a "Minor"), one of your parents or legal guardians must submit a signed, written statement that they have read, understood and agree to these Official Rules with your entry, and that such agreement constitutes acceptance of these Official Rules on behalf of you and themselves. The Promotion and these Official Rules will be governed, construed and interpreted under the laws of the State of Washington. This Promotion is subject to all applicable federal, state and municipal laws and is void where prohibited. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Entries become the property of Sponsor and will not be returned. Sponsor shall not be responsible for late, lost, illegible, incomplete, damaged or misdirected trivia questions, answers or other communications, and accept no responsibility for any injury, loss or damage of any kind resulting from a participant’s participation in this Promotion. Sponsor reserves the right to amend these Official Rules or to terminate this Promotion. By entering the Promotion, you release Sponsor from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or delivery, misdelivery, acceptance, possession, use of or inability to use the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Except where prohibited by law, entry into the Promotion constitutes permission for the Fan Site to provide to Sponsor, and for Sponsor to use, participant’s name, city of residence, likeness and/or prize information, without limitation, for Sponsor's promotional purposes without further permission or compensation. As a condition of being awarded a prize, winners (and if winner is a Minor, winner’s parent or legal guardian) may be required to confirm such permission in writing and execute and deliver a written affidavit of eligibility, acceptance of these Official Rules, release of liability, tax forms, and other reasonable documentation. By entering, participants certify that they have complied with these Official Rules and are eligible to win. For a copy of the winners list or these Official Rules, send a written request with a stamped, self-addressed, business-size return envelope to: Attn: Golden Sun™: Dark Dawn Fan Trivia Contest, Nintendo of America Inc., 4600 150th Ave NE, Redmond, WA 98052. Residents of WA and VT may omit return postage. By entering, participants agree to be bound by these Official Rules and by the decisions of Sponsors, which are final and binding in all respects.
